Terms of service

This is the contract. It is written to be read, not to be survived. The plain-language version on the how-it-works page says the same things.

These documents are not finished

The registered name, registration number, address and phone are still blank infeatures/legal/merchant.ts. A payment provider will refuse an application whose site does not identify the seller, and a lawyer should review the wording before this is published.

1. Who you are contracting with

Using the service means accepting these terms. If you do not accept them, do not use it.

2. What we sell

Advertising placement on a public board attached to a country. Payment creates a position immediately; the higher your total on that country, the higher your card sits. How it works sets out the arithmetic in full and forms part of these terms.

Money moves only from you to us. No user receives money from another user, there is no payout, no withdrawal and no prize. Being outbid costs you your position and nothing else.

3. Your account

  • You must be 18 or over, and able to enter a contract.
  • One person or organisation, one account. Accounts created to manipulate a board may be removed.
  • Your details must be accurate; a confirmed email address is required before you can stake or publish.
  • You are responsible for what happens under your sign-in. Tell us at once if you think somebody else has it.

4. What you may not publish

Your card is seen by everyone. It must not contain, promote or link to:

  • anything illegal where you are or where we are;
  • material that impersonates another person, business or brand you have no right to use;
  • malware, phishing, or a link whose destination is not what it claims;
  • sexual content involving minors, or content that sexualises them in any way;
  • incitement to violence or hatred against people for who they are;
  • deliberately false claims intended to deceive people into parting with money;
  • content that infringes somebody else’s copyright or trade mark.

You keep ownership of what you publish. You give us only the permission needed to display it on the site and in ordinary previews of it.

5. Removal

We may remove a card that breaks clause 4, and we will say which part it broke. Removal for that reason is not refunded. Your stake total is unaffected and remains on the board, but the card does not return until it complies.

If we remove a card for our own reasons rather than yours, the stake behind it is refunded pro rata under the refund policy.

6. Payment

  • Prices are in US dollars and shown before you confirm. The amount you are asked to pay is the amount charged.
  • Payment is taken by a licensed provider. We never see or hold your card details.
  • A position is created only on a successful payment.
  • Refunds are governed by the refund policy, which forms part of these terms.

7. What we promise, and what we do not

We will run the service with reasonable skill and care, keep the boards honest, and apply the published rules to everybody the same way.

We do not promise that a position will bring you customers, traffic or any commercial result. We do not promise the service is uninterrupted; we do promise not to pretend an outage did not happen.

Nothing here limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else the law does not permit us to limit. Subject to that, our liability to you is limited to what you have paid us in the twelve months before the claim.

8. Ending it

  • You may close your account at any time. Positions already paid for are not refunded on closure.
  • We may suspend an account that breaks these terms, and will explain why.
  • If we close the service entirely, we will give notice and refund unexpired positions pro rata.

9. Changes

We may change these terms. Changes that affect you materially are announced by email before they take effect, and the date at the foot of this page always shows which version is in force. Continuing to use the service after that date means accepting the new version.

10. Law

These terms are governed by the law of Ukraine, and disputes go to its courts. If you are a consumer, this does not remove protections you have under the law of the country you live in.
